Introduction

Statistics Jersey is registered as a ‘Controller’ under the Data Protection (Jersey) Law 2018 as we collect and process personal information about you. We process and hold your information in order to provide public services and meet our statutory function to provide statistical reports of interest to, and which assist with decision-making by, public authorities, other undertakings and individuals, including the public.

We’ll continually review and update this privacy notice to reflect changes in our services and feedback from service users, as well as to comply with changes in the law.

This notice explains how we use and share your information. Information may be collected on a paper or online form, by telephone, email, secure file transfer, or by a member of our staff.

What information we collect about you

We receive information that can include your personal data through:

  • your responses to people and household surveys and the census
  • your responses to business surveys
  • collecting data already held on you by other departments, public authorities and organisations for the running of public services: for more details see our spreadsheet on administrative data sources
  • when you contact us by email and phone
  • if you give us your email address to sign up for notifications from our website

Why we collect information about you

We need to collect and hold information about you in order to produce and publish official statistics on:

  • population size and structure
  • projected population size and structure
  • topics such as education, residential status, employment, unemployment, earnings, income, health
  • attitudes, behaviours and opinions of residents
  • Jersey’s economy and labour market

We also may process personal data received over email or by phone calls, or when you sign up to receive notifications from our website, in order to fulfil your request for a service.

How will we use the information about you

We’ll use the information you provide in a manner that conforms to the Data Protection (Jersey) Law 2018 and to the Statistics and Census (Jersey) Law 2018.

Article 12 of the Statistics and Census (Jersey) Law 2018 requires Statistics Jersey to:

  • collect, whether in conjunction with any census or not, data relating to economic, social, demographic and general activities and conditions in Jersey
  • seek to avoid collecting data where data collected for administrative purposes is readily accessible, of suitable quality and sufficiently up to date to enable it to carry out its functions.

We may link data collected from different sources in order to produce the best quality statistics in the most efficient way.

We’ll keep your information as accurate and up to date as required. Statistics Jersey will only continue to hold personal data where it is still necessary to produce statistics, although this may be an extended time in some circumstances if it is still required to produce accurate statistics such as time-series.

We do not process your information using services that are hosted outside the European Economic Area.

Data sharing and publication of information

Under the Statistics and Census (Jersey) Law 2018, Statistics Jersey will not pass your information to anyone outside of Statistics Jersey.

Personal information will only be used for statistical purposes and will not otherwise be published or communicated.

At no time will your information be passed to organisations for marketing or sales purposes or for any commercial use.

We’ll only publish information in a form where individuals and households cannot be identified.

Emails

If you email us we may keep a record of your email address and a copy of the email for record keeping purposes.

We would suggest that you keep the amount of confidential information you send to us via email to a minimum or use our secure online services where possible or correspond with us by post.

We will not share your email address or your email contents unless it’s necessary for us to do so; either to fulfil your request for a service; to comply with a legal obligation; or where permitted under other legislation.

Phone calls

We do not record or monitor any phone calls you make to us using recording equipment, although if you leave a message on our voicemail systems your message will be kept until we are able to return your call or make a note of your message. 

File notes of when and why you called may be taken for record keeping purposes.  We will not pass on the content of your phone calls, unless is it necessary for us to do so; either to fulfil your request for a service; to comply with a legal obligation, or where permitted under other legislation.

Your rights

You can ask us to stop processing your information

You have the right to request that we stop processing your personal data. If we are holding your personal data in order to provide a service to you (such as additional requests for data), this may cause delays or prevent us delivering a service to you. Where possible we’ll seek to comply with your request, but we may be required to continue to hold or process information to comply with our statutory functions, or a legal requirement.

You can withdraw your consent to the processing of your information

If Statistics Jersey require your consent to process your information, you have the right to withdraw your consent to the further processing of your personal data.  We’ll always seek to comply with your request but we may be required to hold or process your information in order to comply with our statutory functions, or a legal requirement. For the majority of Statistics Jersey’s work, our data processing is to comply with our statutory functions and is not done on a consent basis.

You can ask us to correct or amend your information

You have the right to challenge the accuracy of the information we hold about you and request that it is corrected where necessary. We’ll seek to ensure that corrections are made to the data that we hold. As we are unable to share individual level data with other Government departments or organisations, we will be unable to initiate corrections to your data held by those organisations but instead will recommend you contact them separately.

You can request that the processing of your personal data is restricted

You have the right to request that we restrict the processing of your personal information.  You can exercise this right in instances where you believe the information being processed is inaccurate, out of date, or there are no legitimate grounds for the processing. We’ll always seek to comply with your request but we may be required to continue to process your information in order to comply with our statutory functions, or a legal requirement.

You can ask us for a copy of the information we hold about you

You are legally entitled to request a list of, or a copy of any information that we hold about you. You can submit a subject access request (SAR)

However where our records are not held in a way that easily identifies you, we may not be able to provide you with a copy of your information, although we’ll do everything we can to comply with your request.
